These Terms govern your use of Homes 4 Sale (homes4sale.es), operated by Homes4Sale (Melkerson & Nott S.L.). By using the platform, creating an account, listing properties, submitting enquiries or subscribing, you agree to them. If you do not agree, do not use the service. 1. Definitions

• Agency — any estate agency, professional, developer, seller or landlord using the platform to advertise or manage listings.
• Content — anything uploaded or published, including text, photos, videos, prices, logos and messages.
• Listing — a property advertisement displayed on the Website.
• Services — the Website and all related listing, enquiry, subscription and support features.
• User — anyone who accesses the Website, including visitors, property seekers, Agencies and account holders.

2. Nature of our service

We are an online listing and advertising platform only. We are not an estate agency, broker or any kind of adviser; we do not own, verify or manage the properties listed, and we are not a party to any transaction. We do not guarantee the accuracy, legality or availability of listings, or the identity or reliability of Users. You are responsible for your own checks and independent advice.

3. Eligibility & accounts

You must be at least 18 and have legal capacity to use the Website. Keep your login details secure, provide accurate information, and take responsibility for activity on your account.

4. Subscriptions, fees & payment

Subscriptions let Agencies upload and promote listings; features and pricing are shown on the Website. Fees are payable in advance, subscriptions renew automatically, and payments may be processed by third parties. All payments are final and non-refundable except where the law requires otherwise — see our Refund Policy. Cancellation stops future renewals but does not trigger a refund.

5. Listings & content

Users are responsible for the accuracy and legality of their listings; we do not guarantee listing accuracy or the delivery or outcome of enquiries. You grant us a licence to use your Content to operate and promote the platform. All platform content is protected by intellectual property laws.

6. Acceptable use

Do not use the Website unlawfully, scrape or automate it, or post misleading listings. We may moderate, remove or take down content or accounts that breach these Terms.

7. Liability

The Services are provided “as is” without warranties, and we do not guarantee uninterrupted availability. To the maximum extent permitted by law, our liability is limited, and you agree to indemnify us against claims arising from your use. We are not liable for third-party services or for events beyond our reasonable control (force majeure). Your mandatory consumer rights are not affected.

8. Suspension & termination

We may suspend or terminate accounts that breach these Terms. Confidential information exchanged through the platform must be protected.

9. General

We may update these Terms and will post changes here. We may assign our rights; you may not without our consent. If any provision is invalid, the rest still applies, and not enforcing a right is not a waiver. These Terms are the entire agreement between us. The English version prevails unless mandatory law requires otherwise, and these Terms are governed by Spanish law. Data protection is covered by our Privacy Policy.
